TERMS OF SERVICE FOR NSE Real Estate Advisor

Introduction

These Terms of Service (“Terms”) govern your access to and use of the website, tools, and services provided by NSE Real Estate Advisor (“we,” “our,” or “us”). By accessing or using any part of our services, you agree to be bound by these Terms, along with our Privacy Policy. If you do not agree, you must discontinue use of the Services.

Overview and Eligibility

NSE Real Estate Advisor provides on-demand technology consulting, systems integration, technical support, and related professional services for individuals, businesses, and real estate professionals. By using our Services, you confirm that the information you provide is accurate and that you are legally able to enter into this agreement.

You must be at least 18 years old, or the age of majority in your Canadian province or territory, to use the Services. By using the Services, you represent that you meet this requirement.

Scope of Services

Our Services may include, but are not limited to:
Technology setup, configuration, troubleshooting, and consulting
Systems integration and automation
AI, workflow, and business optimization
Technical support for real estate and small business professionals

We may modify, expand, restrict, suspend, or discontinue Services at any time. We are not liable for such changes.

Consultations, Payments, and Billing

When booking or purchasing Services, you agree to:
Provide accurate and complete information.
Attend scheduled consultations or provide at least 24 hours’ notice to reschedule.
Understand that consultation fees are non-refundable once a session has been delivered.

All fees are listed in Canadian Dollars (CAD) unless otherwise stated. Payments are collected through secure third-party processors. By purchasing Services, you agree that:
Payment is due before or at the time Services are delivered.
Subscriptions or recurring Services may renew automatically unless cancelled.
You are responsible for all applicable taxes, including HST, GST, or PST.

NSE Real Estate Advisor is not responsible for payment processor errors, delays, or issues originating from third-party systems.

Intellectual Property and Acceptable Use

All content provided through the Services, including text, graphics, branding, videos, documentation, and software, is the property of NSE Real Estate Advisor or its licensors and is protected under Canadian and international copyright and intellectual property laws.

You may not:
Copy, distribute, reproduce, or modify our materials without written permission.
Use the Services for illegal, abusive, or fraudulent purposes.
Attempt to gain unauthorized access to systems or data.
Resell, sublicense, or commercially exploit the Services without consent.
Misrepresent your identity or impersonate any individual or business.

We may immediately suspend or terminate your access if you violate these Terms.

Third-Party Tools and Service Integrations

Some of our Services may rely on third-party platforms such as Google Workspace, Zoom, Microsoft, OpenAI, or other service providers. These third parties are responsible for their own performance, uptime, data handling, and policies.

Your use of third-party integrations is governed by their respective terms and conditions. NSE Real Estate Advisor is not responsible for failures, outages, or issues caused by external systems.

Disclaimers

Our Services are provided “as is” and “as available.” We do not guarantee:
Uninterrupted or error-free operation
Compatibility with all systems or devices
Specific results, outcomes, or performance improvements

You are responsible for ensuring that any recommendations, automations, or technical changes implemented through our Services comply with your industry requirements, regulatory obligations, or real estate board rules.

Limitation of Liability

To the fullest extent permitted under Canadian law, NSE Real Estate Advisor and its affiliates are not liable for:
Indirect, incidental, special, or consequential damages
Loss of data, loss of business, or business interruption
Harm caused by third-party software, integrations, or user misuse

In all cases, our total liability is limited to the amount you paid for the specific Service giving rise to the claim.

Some provinces do not allow the exclusion of certain warranties or limitations. Where prohibited by law, these limitations may not apply to you.

Privacy and Handling of Personal Data

NSE Real Estate Advisor handles personal information in accordance with applicable Canadian privacy laws, including PIPEDA, and our Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of your information as described therein.

Termination

We may suspend or terminate your access to the Services if:
You violate these Terms
You engage in fraud or unlawful behaviour
You fail to pay for Services
You misuse the Services in any way

Upon termination, your right to use the Services ends immediately. Any outstanding charges remain payable.

You may stop using the Services at any time. Cancellation does not entitle you to refunds for previously delivered Services.

Changes to These Terms

We may update or revise these Terms periodically. When changes are made, we will update the “Last Updated” date at the top of this page. Continued use of the Services after changes are posted means you accept the revised Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable within Ontario. Any disputes arising from these Terms or your use of the Services will be resolved exclusively in the courts of Ontario.
